Kate Riviello has authored a criminal complaint, with cat owner Stefanie Petsche, against an individual who is both an animal rescue and employee of Animal Care Center – NY(SI) alleging fraud, conspiracy, theft/conversion (Maddie’s Fund and other grants), falsifying a government instrument and animal cruelty. Activist/paralegal Kimberly Serino who has been independently investigating Angel’s Gate for seven years assisted. The cat named “Trebble” has become lost forever into the labyrinth of the corruption and mismanagement of what is ACC-NY. A blog post will be completed by Monday October 19th including a letter to the Attorney General at http://www.kateriviello.wordpress.com. The cat “Trebble” may still be alive and we have demanded from the District Attorney that a search warrant be issued to properties that are implicated in the disappearance of possibly hundreds if not thousands of cats that were pulled from the ACC-NY system and dumped at various locations never to be seen again (including Angels Gate with Susan Marino having been convicted of animal cruelty and today’s court-ordered sale of said property). It will be requested from the Attorney General to commence an investigation and subpoena of ALL animals that have been pulled from ACC-NY for the past five years by the “Mayor’s Alliance” (through the New Hope Department at ACC-NY) and those dispositions (alive at foster or adopter, dead by illness, killed at vet for temperament, lost, still in boarding, “placed” in “feral” colonies” and last vetted, etc) be made public for dissemination and scrutiny by donators. The City has sanctioned “trap, neuter, release” covert locations for cats, however, placing additional cats into those colonies after having been pulled from death row has come into question.

Riviello has led the protest campaign against ACC-NY for what she claims is felony animal cruelty with killing of animals before the hold time and “mistakenly” killing animals with adopters and rescue holds, as well as lack of veterinary care. A criminal complaint was filed against ACC-NY in Brooklyn for lack of veterinary care for a dog named Jackie (http://www.kateriviello.wordpress.com) but the PD and DA never initiated an investigation to her knowledge. Riviello also filed the first lawsuit against NYPD for lack of enforcement of animal cruelty laws in NYC which was denied in Supreme Court of NY for lack of standing (though a precedent setting case in NY against the USDA for a citizen to file for animal cruelty has been decided).

This Friday evening 10/16 at 10pm, Riviello will lead a national protest outside ACC-NY on 110th Street with copies of the criminal complaint for the press and attendees. Approximately 10-15 activists will sleep outside all night at ACC-NY and these various locations across the country in lounge chairs and sleeping bags.

**Houston, Texas, BARC has resorted to killing dogs and cats upon arrival with a stray population in dizzying numbers of hundreds of thousands;
**Dallas, Texas, a councilperson has suggested that loose dogs and cats be killed from helicopters and on sight by law enforcement;
**Miami, Florida, Breed Specific Legislation against pit bulls is a death sentence and all animals entering MDAS are in grave danger (contact Ale Ochea (786) 251-2362, Redlands, FL The Abandoned Dogs);
**Chicago is riddled with undercover eyewitness accounts of killing dogs and cats with empty cages available and lack of even basic care;
**Minot, North Dakota, persists in unconstitutional BSL and accounts of illegal search and seizure of dogs from homes in Chinese-style raids; and
**Lancaster, CA, killing unchecked with no accountability as to the bodies of animals when they leave the kill pound suggesting a conflict of interest to laboratories and rendering plants.

It is alleged that cats that have been pulled from death row, with grant dollars collected, that they have been shipped up to Angel’s Gate and other locations in U-haul trucks (illegal) and dumped on this 98 acre property with nothing but Amish sheds to protect them from zero degree weather and blizzard like conditions in coyote infested woods. With all the monies garnered from grant dollars one would think that REAL RESCUE WOULD HAVE ENTAILED BUILDING HEATED BARNS WITH RUNNING WATER. Even if the barns were heated to 40 degrees and the cats could be kept inside those barns and inside fenced in areas safe from coyotes, THAT would have been rescue – not this scenario – this is not rescue.

      1. Indeed but Susan Marino has now only been ordered off the property. If these unscrupulous practices were occurring with the full knowledge and consent of the Mayors Alliance since 2008 then we have no confidence whatsoever that animals were not still being dumped there after 2013. We are not sure of the numbers of animals that are currently there. We are awaiting subpoenas and search warrants to explore these issues further.

    2. I have wrote the nyc alliance for years, grants not used nyc Maddie grant?? Please I have never gotton a response.. we tried to remove the female Hilter director to no avail. She kills pits almost immediately.. puts no holds on them, breaks the law over and over. Their ac is disgusting. Dirty, animal are given no medical care, they kill them for sniffles.. sicking

        I have a couple of questions for you.
        1. How do people know who are the reputable rescues (who pull from NYC ACC) and who are not? How do I know my pledges are actually going towards the cat I pledge for? We rarely if ever get after rescued pictures and I’m starting to wonder if I’m not being duped, 501c or not.
        It only takes a few seconds to take a picture from a phone and maybe another minute to post it on social media. I have cut back on my pledges for this reason.

        2. What does ACC do with All these dead animals? I cannot find any public information about this and since they are a multimillion dollar non-profit organization why isn’t this public knowledge?

        The dog and cat fur trade is big business, they use dead dogs, cats, horses in commercial pet food (which I will never feed my cat ever again) schools and labs use dead animals, where are the hundreds of dead animals going, do you know?

        NYCACC has blocked me on Twitter & Instagram for questioning them they said I didn’t know the meaning of a No-Kill shelter, call me stupid but killing healthy adoptable animals on a daily basis is a high kill shelter.
        They are opening a “Pet Food Bank” at the Bronx location, I guess they think opening a pet food bank it will erase the past and present mass murders they are committing, all this shows me is that they are finally feeling the pressure of the public and we have to stay on them now more than ever.

        PBS is going to show a new episode of “Shelter Me” and NYCACC are telling their followers how this episode will feature them and “all they do to help animals get adopted” I wanted to vomit after I read that. PBS is publicly funded so please be a voice and let them know your thoughts on this. I have yet to get a confirmation date from PBS when this will air.

      2. Thank you so much for your comment. It has taken me five years to actualize this criminal complaint. I have seen rescues, even in high profile cases, kill animals with impunity. I have also seen some of the Mayors Alliance rescues break their backs and sacrifice everything for these babies. Finally due to the fumbling of paperwork and a few interviews, the charges could be filed. That in and of itself is a victory. Remember we are filing a criminal complaint against very wealthy people. Traditionally wealthy people have a different standard of justice in society. These charges allege the Mayors Alliance Board of Directors were aware of and a party to the allegations.

        Regarding your question, to their credit, it does state on the animal listing sites that the pledge or donation is appropriated to the rescue that pulls that animal NOT to the animal specifically. I did see a reference once to a directive to participants that if they DO ask for a “happy pic” (or I gather ANY evidence that the animal is safe or still alive) that they will be banned in that the rescues do not have “time” to post out every animal’s disposition. Like yourself, I disagree with the lack of this super important step as an assurance to the public that the protocols and practices of ethical rescue are carried out.

        To my knowledge, the ACC-NY disposes of animals by cremation. I am not aware of the vendor’s name.

        If you have been called “stupid” by a particular individual or website, if you have a screenshot of that, we would be interested in acqusition of that screenshot. And of course you are absolutely right, killing a healthy adoptable animal is NOT “no-kill.” It is NOT “no-kill” to even kill an animal that is sick or of a certain behavior that every effort has been made to treat that animal.

        We have acquired affidavits that find culpable higher-ups of the Mayors Alliance for these allegations. We must followup with the District Attorney of Staten Island at this point. Furthermore we will release an entire report to the Attorney General demanding a full investigation into this matter. We are also utilizing our findings of these allegations to prove to the NY State Legislature that it is time to re-think the Department of Health, ACC-NY and Mayors Alliance grip on the care of animals in NYC. Their handling of these animals has been an abject failure obviously. Thank goodness for the handful of rescuers that are responsible for the lives being saved. I know who the real rescuers are and naturally we wish to have them continue under an entirely new system under a new nonprofit with an “open bid” (which would have to passed by law in NY State in Albany.)

        This is not a fluff piece. Media will be reticent to assign an investigative reporter into entities that they have supported publicly in the past. Justice is not being served to the animals.

If you know of a media source and their email, please forward and ask them to cover this matter. We will also release the DA’s phone number for Staten Island with a poster campaign to pressure them to effect an arrest.

  2. I’m sickened by the constant disregard for our world’s animals! A friend and mutual animal lover just sent me this article. I’m surprised at the Mayor’s Alliance! I was informed by their operations manager that they save 87% of their intakes, and can see that number increase to 90% by years end.
    I emailed them to get stats for a novella I wrote addressing homeless animals and shelter abuse.
    In the appendix of my novel, I listed several animal organizations that need public help, and ACC, Dade Animal services are included in this list. It is my attempt to increase animal adoptions and public support.

The truth is, Rescuers have been TRYING to hold the MA and ACC accountable for quite a while now – for this exact behavior…we’ve speaking out for the better part of the last two years – at least – on this issue, imploring every one of the city’s “ANIMAL WELFARE” agencies to listen, acquire the FACTS, and then DO something about it. And we have been resoundingly ignored. DUMPING IS NOT RESCUE, no matter who does it, nor is it “relocation” as these agencies like to claim…mostly because they are complicit in the practice. Until killing…whether active or passive…is taken OFF the table as a method of dealing with shelter overpopulation, a humane solution will never be necessary. ATTN: everyone i sent an email or called about this in the last two years: YOU SHOULD BE ABSOLUTELY ASHAMED OF YOURSELF. I can only hope that this more public indictment of how you have FAILED the animals you claim to serve will make more waves than i could.

  6. this makes me so sick and angry – I have 7 adopted as adult cats and love them – and all cats – more than life itself. I could never understand how anyone who claims to be a human being could inflict pain and suffering on innocent animals – cats have a right to live in peace and harmony in this world and we should be protecting them – shame on any group who claims to be helping when in truth they are killing them – you disgust me — and being a native New Yorker the ACC has always just killed their animals taking the “easy and cheap” way out – shame on them all

  7. I applaud the efforts and actions being taken. Thanks to everyone, especially Kate, for all the hard work you are doing to stop this abuse and right the wrongs. If a national investigation was done on shelters across the U.S. and abusive rescue groups i shiver to think what would be discovered. Count me in, this is so wrong and has to be stopped.

  8. After looking over their taxes, looking into rescues and watching the practices of NYACC and watching the recent board meeting videos it is clear it’s about money (which most of us already realize) but it’s more than money, it is power and it seems no one can be trusted anymore.
    I’ve noticed Urgent Podr has started defending NYCACC, deleting comments made about ACC and they are blocking people who comment badly about ACC, to me this crosses the trust line they initially worked so hard to obtain.

    Kate, NYCACC did not call me stupid, I was saying “call me stupid but killing healthy animals is not no-kill”, as they are now claiming they are. I wanted to clarify this and had they said this I would certainly share with you.

    I noticed on Twitter that ACC is asking for $45k in donations to hire a dog walker, I think a dog walker is needed but I’m more shocked that they don’t already have a few now, when they are bringing in upwards of $16 million a year and cannot budget for a dog walker then clearly they cannot manage the money they already get now. Watching the daily waste of money they spend on vaccinating then killing the animal 2-3 days later or spaying then killing days later is a system that cannot budget themselves nor are they capable of reforming themselves at this point with this current management.

    I am a supporter but who to trust is a very big question. Thank you for having the balls to take on something much bigger than most are aware of.
